1. Acceptance of Terms

By accessing and using BookGather, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of BookGather per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials
  • use the materials for any commercial purpose or for any public display (commercial or non-commercial)
  • attempt to decompile or reverse engineer any software contained on BookGather
  • remove any copyright or other proprietary notations from the materials

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

4. Event Bookings and Payments

All event bookings are subject to availability. Payment processing is handled securely through Stripe. Refund policies vary by event and are clearly stated during the booking process.

5. Marketplace Transactions

BookGather operates a marketplace where authors and organizers can sell books and merchandise. By using the marketplace:

  • Buyers agree to pay for items as listed and provide accurate shipping information
  • Sellers agree to accurately describe items, fulfill orders promptly, and ship items as specified
  • BookGather charges a 10% platform fee on all marketplace sales
  • Payment processing fees (Stripe: 2.9% + $0.30) apply to all transactions
  • Sellers are responsible for collecting and remitting applicable sales taxes
  • Refunds and returns are handled between buyers and sellers according to the seller's policies
  • BookGather reserves the right to mediate disputes but is not liable for transaction issues

6. Content

Users may post content such as event descriptions, profiles, product listings, and reviews. You retain ownership of content you create, but grant BookGather a non-exclusive, worldwide license to use, modify, and display such content on our platform.

7. Email Marketing and Communications

By using BookGather, you agree to receive communications from us and, when applicable, from authors you interact with:

  • Transactional Emails: You will receive essential emails related to your account, bookings, and transactions
  • Event Reminders: If you book an event, you will automatically receive reminder emails (7 days, 24 hours, and 1 hour before the event)
  • Post-Event Communications: After attending an event, you may receive a follow-up email thanking you and requesting a review
  • Marketing Communications: When you sign up for newsletters or download lead magnets, you consent to receive marketing emails from the respective author or organizer. You can unsubscribe at any time
  • Author/Organizer Obligations: If you are an author or organizer sending emails through our platform, you agree to comply with CAN-SPAM Act, GDPR, and all applicable email marketing laws

Unsubscribe Rights: You may unsubscribe from marketing communications at any time by clicking the unsubscribe link in any marketing email or by managing your preferences in your account settings. Transactional and event-related emails cannot be unsubscribed as they are essential to the service.

8. Landing Page Builder and Author Tools

BookGather provides authors, organizers, and venues with tools to create landing pages and marketing materials. By using these tools, you agree that:

  • You are responsible for all content you create and publish on your landing pages
  • Your landing pages must comply with all applicable laws and these Terms of Service
  • You will not use landing pages to collect personal information for purposes outside of BookGather's services
  • You will not create misleading, deceptive, or fraudulent content
  • You grant BookGather a license to host and display your landing pages on our platform
  • BookGather reserves the right to remove or disable any landing page that violates these terms
  • Lead magnets (free content offered in exchange for email signups) must be delivered as promised and must not contain malware or inappropriate content

Analytics and Tracking: Landing pages may track visitor data and conversions. This data is provided to you for marketing purposes and is subject to our Privacy Policy.

9. Anti-Spam and Email Abuse Policy

BookGather has a zero-tolerance policy for spam and email abuse:

  • Authors and organizers may only send emails to users who have explicitly opted in through BookGather
  • All marketing emails must include a clear and functional unsubscribe mechanism
  • You must honor unsubscribe requests within 10 business days
  • Purchasing, renting, or trading email lists is strictly prohibited
  • Sending unsolicited bulk emails through our platform is prohibited
  • Misleading subject lines, fake sender information, or deceptive content is prohibited

Consequences of Violation: Violation of this policy may result in immediate account suspension or termination, removal of all landing pages and content, and potential legal action. We reserve the right to report violations to relevant authorities.

10. Prohibited Uses

You may not use our service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To sell counterfeit, stolen, or prohibited items through the marketplace
  • To manipulate reviews or ratings
  • To circumvent platform fees or payment processing
  • To send spam, unsolicited emails, or violate email marketing laws
  • To scrape, harvest, or collect email addresses from our platform
  • To create landing pages with malicious content, malware, or phishing attempts

11. Disclaimer

The information on this website is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms related to our website and the use of this website.

12. Limitation of Liability

In no event shall BookGather, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, punitive, consequential, or similar damages. BookGather acts as a platform connecting buyers and sellers and is not responsible for the quality, safety, or legality of items listed, the truth or accuracy of listings, the ability of sellers to sell items, or the ability of buyers to pay.

13. Changes to Terms

We reserve the right to revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.
